CHARTER OF THE BUDGETARY INSTITUTION OF THE REPUBLIC OF KALMYKIA “STATE DANCE THEATER OF KALMYKIA “OIRATY”

1. General provisions

1.1. The budgetary institution of the Republic of Kalmykia, the State Dance Theatre of Kalmykia “Oiraty” (hereinafter referred to as the Institution, the Theatre), was established by changing the type of the state institution “State Dance Theatre of Kalmykia ‘Oiraty’” in accordance with the order of the Government of the Republic of Kalmykia dated December 19, 2011, No. 355‑r.

1.2. The Institution is a non‑profit organization carrying out professional activities in the field of choreographic and theatrical‑choreographic art.

1.3. In terms of its organizational and legal form, the Institution is a state Institution.

1.4. The official name of the Institution:

full name: Budgetary Institution of the Republic of Kalmykia “State Dance Theatre of Kalmykia ‘Oiraty’”;

abbreviated name: BU RK “SDT “Oiraty”.

1.5. Location of the Institution:

legal address: Republic of Kalmykia, Elista, Lenin St., 201a;

actual address: 201a Lenin St., Elista, 358000, Republic of Kalmykia.

1.6. The founder and owner of the Institution’s property is the Republic of Kalmykia.

The functions and powers of the Founder of the Institution are exercised by the Ministry of Culture and Tourism of the Republic of Kalmykia (hereinafter referred to as the Founder); the powers of the Owner of the Institution are exercised by the Ministry of Land and Property Relations of the Republic of Kalmykia (hereinafter referred to as the Owner).

1.7. The Institution carries out its activities in accordance with the legislation of the Russian Federation and this Charter.

1.8. The institution is a legal entity and on its behalf may acquire and exercise property and personal non-property rights, bear responsibilities, and be a plaintiff and defendant in court.

1.9. The establishment of representative offices and branches does not have.

1.10. The institution is responsible for its own activities, including the selection and placement of personnel, as well as financial, economic, and other activities within the limits established by the legislation of the Russian Federation.

1.11. The institution has the right to:

a) to use the results of intellectual activity and means of individualization equivalent to them in accordance with the procedure and under the conditions provided for by the legislation on copyright and related rights;

b) to independently form its economic program, determine the procedure for selling tickets, services and products, and set prices for them in accordance with the legislation of the Russian Federation;

c) to hire and dismiss employees in accordance with the labor legislation;

d) to participate, in accordance with the established procedure, in the implementation of federal and interstate targeted programs in the field of culture and art in which the Russian Federation participates;

e) to form various professional creative collective formations.

The institution must:

a) properly fulfill their obligations in accordance with their terms, requirements of laws, other regulatory legal acts, and in the absence of such conditions and requirements – in accordance with business practices or other commonly imposed requirements;

b) to provide social, medical, and other types of mandatory insurance for its employees in accordance with the legislation of the Russian Federation, to ensure that they have the necessary conditions for work, and to pay wages in a timely manner in accordance with the legislation of the Russian Federation;

c) ensure the minimum wage guaranteed by the legislation of the Russian Federation , working conditions and social protection measures for employees, and be responsible for damage caused to their lives and health.

1.12. The Institution ensures the openness and accessibility of the following information:

information about the date of establishment, the structure of the Institution, income and expenditure of financial and material resources based on the results of the financial year; the plan of financial and economic activities of the Institution; the procedure for the provision of paid services, including a sample contract for the provision of paid services, indicating the cost of services; information specified in clause 3.2 of Article 32 of Federal Law No. 7-FZ dated January 12, 1996 “On Non-Profit Organizations”.

2. Subject, tasks and types of activities of the Institution

2.1. The institution carries out its activities in accordance with the subject and objectives of its activities by providing concert services to the public and performing work on the preparation and holding of festivals, competitions, conferences, screenings and other spectacular performances (events), on the creation and screening of concerts and concert programs, methodological work and information support in the established field of activity, for the dissemination of an artistic product (concert programs, other entertainment performances, events) through public display in live performance, including on tour.
